    What Is a Settlement Agreement?

A settlement agreement is a legally binding contract between an employer and employee, resolving employment-related disputes, or termination.
It offers compensation in exchange for waiving your rights to bring future claims. Proper legal advice is essential to understand the terms and ensure a fair deal.

    Frequently Asked Questions

Why do I need to sign an agreement?

Settlement agreements allow employers to settle or prevent potential claims by employees. In return for waiving your right to bring future claims (with some exceptions), you will receive compensation. If you choose not to sign, your employer may withhold the compensation or offer a reduced amount.

When will I get my money?

Your settlement agreement should specify the payment timeframe. If you’re unsure or need clarification, please contact us for assistance.

Will your costs come off my compensation payment?

No. You will receive the full compensation. In most cases, your employer will cover our legal fees entirely.

Will I have to pay tax on the compensation payment?

Tax implications depend on the payment breakdown:

    • Wages and holiday pay are subject to tax and National Insurance (NI).
    • Compensation payments for loss of employment are generally tax-free up to £30,000.
    • Payments in lieu of notice is subject to tax and National Insurance (NI)

If you need more specific advice, ask us or consult an independent financial advisor. Be aware that most agreements stipulate you are responsible for any tax or NI the Inland Revenue later deems payable.

What claims can I still bring after signing the agreement?

After signing, your ability to bring claims is typically limited to:

    1. Breach of contract — if your employer fails to meet the agreed terms.
    2. Personal injury claims — excluding injuries you were aware of before signing (e.g., stress or anxiety-related illness in redundancy cases).
    3. Pension rights — you can still make claims related to accrued pension entitlements.
Can I discuss the agreement with others?

This depends on whether the agreement includes a confidentiality clause. Some clauses restrict disclosure of the agreement’s terms (such as the compensation amount), while others may prohibit disclosing the agreement itself. Contact us if you have questions about confidentiality.

Can I speak freely about my employer now?

Many agreements include a non-derogatory statements/non-disparagement clause. This prevents you from making negative remarks about your employer or its staff. Be mindful of your comments, especially in public forums.

Can I go to the press about my case?

This depends on the confidentiality and non-derogatory statements clauses. Always seek advice before speaking to the media after signing a settlement agreement.

Will my employer provide a reference?

Employers are not generally obligated to provide references, but any reference they give must be accurate and fair. We can help negotiate the inclusion of a reference clause in your agreement. Note that this may delay the signing process.

What does “entire agreement” mean in my settlement agreement?

An “entire agreement” clause means verbal promises or informal assurances not written in the agreement are unenforceable. For example, if your employer verbally agrees to provide a reference but it’s not in the signed document, you cannot rely on it legally.
